Photo Licensing
Kiarah Studios (KS) retains all rights, licenses, copyrights, titles, descriptions, and ownership of the media contained in KS websites, portals, digital and physical products. The term Kiarah Studios or KS encompasses all businesses under or associated with Kiarah Studios, including but not limited to Kiarah Photography, Kiarah Portraits, Kiarah Studios, Kiarah Designs, Kiarah Backdrops, Kiarah Media, Kcaptured, Kiarah Session, Kiana Portraits, Kiana Photography, and others. Digital media and/or products may be available for purchase through the online store or by contract with KS. KS grants the buyer a non-exclusive, non-transferable, perpetual, non-commercial license to download and copy the agreed-upon media and/or products, subject to the following restrictions.
License Restrictions:
- The license is solely for personal use and non-commercial work. No commercial use of the media is permitted unless a commercial license is purchased.
- Title, ownership, copyright, and all rights, both current and future, of the media and/or products remain exclusively with KS.
- There are no warranties, express or implied, under this provision. The customer accepts that the media and/or products are provided ‘as is’.
- KS and/or its vendors are not liable for any additional third-party claims, incidental, consequential, or otherwise alleged damages arising out of the license or buyer’s use of the purchased media and/or products.
Media Usage:
- KS reserves the right to use media contained in digital and physical products for promotions, marketing material, portfolios, websites, and social media platforms.
Customer Allowable Actions:
- Display products and media on personal websites and computers.
- Make images and/or prints for personal use.
Customer Barred Actions:
- Resell, relicense, sub-license, or otherwise redistribute media and products without express written permission from KS.
- Use media in any fashion that requests and/or charges others money or fees, or receive financial compensation for the usage in advertising.
- Utilize media or products in a pornographic, explicit, illegal, immoral, slanderous, defamatory manner, or associate them with such content.
- Incorporate media, products, or KS brand/logo into trademarks, logos, or service marks.
- Make purchased media or products available for download.
- Utilize media or products for business, educational, events, or other non-personal uses, which require a commercial license.
Personal Information
We collect various types of personal information when you use our websites, mobile sites, or mobile applications (our “Sites and Apps”), purchase products or services, schedule appointments, visit our locations, engage with us through customer service or social media, sign up for notifications or customer rewards programs, access emails, or participate in surveys and contests. This information may be collected directly from you or indirectly through your device or browser.
Usage of Personal Information:
- Fulfill product orders, customize advertising and content, offer personalized product suggestions, deliver marketing communications, provide customer service, protect database and website security, detect and prevent fraud, and improve products and services.
Third-Party Providers:
- We use third-party service providers for shipping, payment processing, enhancing shopping experience, delivering advertisements, and other services. These providers can only use your information for the services they provide.
Information Sharing:
- We may share your information with organizations you are affiliated with if photographing pursuant to a contract with them.
- We may be required to share information to respond to legal processes, comply with laws, protect database security, or in the event of corporate changes.
- Your information may be transferred to another organization if we merge, acquire, liquidate assets, or undergo changes in ownership.
Photo Data Retention
- Raw photos are retained for up to 12 months after the event.
- Processed photos are retained in password-protected albums for up to 5 years.
- Photos and albums can be deleted permanently upon receiving an express written request. Once deleted, photos cannot be retrieved.
Security:
- We have safeguards in place to protect against unauthorized access and disclosures. However, we cannot guarantee complete security.
Data Retention:
- We retain your information only as necessary to provide services, comply with legal obligations, resolve disputes, and enforce agreements.
